Terms of Service

Terms for using Fantasy Card Creator, creating cards, sharing them, and purchasing credits.

Effective date: 9 October 2026 ยท Last updated: 9 October 2026

1. About these Terms

These Terms of Service are a legal agreement between you and Appetent Ltd, the New Zealand company that operates Fantasy Card Creator.

They apply to your access to and use of the Fantasy Card Creator website and services, including creating, saving, downloading, printing, sharing, and purchasing credits for fantasy cards.

By using Fantasy Card Creator, the parent or guardian responsible for the account confirms that they have read, understood, and agreed to these Terms and are authorising the child's use of the service. If you do not agree to these Terms, you must not use the service.

Fantasy Card Creator is designed for children and families. A parent or guardian must control the account and complete the required parent-verification step before a child can create cards.

Our Privacy policy explains how we handle personal information. These Terms and the Privacy Policy should be read together.

2. The service

Fantasy Card Creator lets users choose or describe fantasy creatures, generate card art and text using third-party AI services, save cards to a private gallery, and download, print, or share cards. We may change, pause, or remove features as the service develops. We will handle already-purchased paid credits fairly if a feature changes.

3. Accounts and access

Sign-in uses an email magic link and may also support Google sign-in. We do not store a conventional account password. You must control the email address or Google account used to sign in and must not use another person's account. If you lose access to that provider, recovery may depend on the provider; we do not promise manual account takeover.

4. Parent and child use

This is a child-directed service. A parent or guardian must agree for a child and control the account. Fantasy Card Creator collects the prompts and pictures. Those prompts and pictures are sent to the AI vendors to make the card.

A parent or guardian must confirm consent through our parent-verification email flow before card creation. Email or Google sign-in authenticates an account but does not by itself prove parental consent. Kids Web Services provides the verification service we use, but using it does not by itself determine whether Fantasy Card Creator complies with COPPA or other privacy laws. Children must not independently create accounts or make purchases. Email or Google sign-in alone does not prove that someone is a parent.

5. Your prompts and cards

As between you and Appetent Ltd, you retain any rights you have in prompts, card choices, and other content you submit. We process this content to provide the service, but we do not guarantee that every prompt can be retrieved after generation, deletion, or expiry. You own the cards you create to the extent applicable law recognises those rights, but AI output may not qualify for copyright protection, may be inaccurate or unsuitable, and may not be unique. We do not guarantee that a card is free from similar outputs or third-party rights. Review a card before sharing, printing, or using it commercially.

You give Appetent Ltd and its service providers a limited permission to process, store, format, resize, transmit, and display your content only as needed to provide, secure, maintain, and improve the service. Cards and galleries are private by default. A user may create a shareable card link or download or print a card. Anyone who receives a shareable link may be able to view that card without signing in.

6. Feedback

If you send us suggestions, ideas, comments, or other feedback about Fantasy Card Creator, you allow Appetent Ltd to use that feedback without payment or restriction to operate, maintain, and improve the service. This does not transfer ownership of your prompts, card choices, cards, or personal information to Appetent Ltd, and we do not require you to send confidential information as feedback.

7. Appetent's intellectual property

Appetent Ltd owns or licenses the Fantasy Card Creator website, software, design, branding, layouts, text, and other platform materials, excluding content that belongs to users or third parties. Subject to these Terms, we give you a limited, personal, non-exclusive, non-transferable, and revocable permission to use the service for its intended purpose.

You must not copy, sell, sublicense, reverse-engineer, scrape, or create a competing service from the platform or its protected materials, except where applicable law does not allow us to restrict that activity.

8. Acceptable use and AI limits

Do not submit content that is unlawful, harmful, abusive, invasive of another person's privacy, or that you do not have permission to use. Do not deliberately request unauthorised copies or imitations of protected characters, brands, celebrities, or artworks. AI providers may automatically reject some requests. We may restrict or remove content that is reported, detected, or brought to our attention, and may suspend an account for serious misuse. We do not proactively review every private card.

Do not bypass credit limits, scrape the service, reverse-engineer it, attack it, or use automation unfairly. If a generation fails or is rejected, the related credit should be restored where our systems can do so.

9. Sharing

A Shareable Card Link can be viewed by anyone who has the valid link, without signing in. Do not share a link with people you do not trust. A card owner may turn sharing off where that control is available. External social platforms have their own terms and privacy practices, which Appetent Ltd does not control.

10. Credits, payments, and refunds

Credits are one-time purchases, not subscriptions, and do not expire while the service remains available. Prices and packs are shown before checkout. Settlement is in NZD; Stripe Adaptive Pricing may display a local currency at checkout while settlement remains in NZD. A card issuer or Stripe may charge a conversion fee. Refunds of those payments use the original exchange rate. Stripe processes payment-card details, and Appetent Ltd does not store full card numbers. GST and other taxes may apply where required.

A successful generated card consumes a credit and is not automatically refundable merely because a customer changes their mind. Unused paid credits are not refundable solely because a customer changes their mind, no longer wants them, or does not use them. We may consider a refund in exceptional circumstances, such as a duplicate or unauthorised charge, a technical problem caused by us that prevents the credits being used, or if we discontinue the service before the credits can reasonably be used. Refunds will be handled in accordance with applicable law. Free or promotional credits have no cash value and are not transferable. Credits are account-bound and may not be resold, transferred, or redeemed for cash. Nothing in this section limits any mandatory rights or remedies available under the New Zealand Consumer Guarantees Act, the Fair Trading Act, or other applicable law.

If we suspend or close an account for serious misuse, prohibited content, fraud, or a chargeback, any unused paid credits will be handled case-by-case rather than automatically forfeited. If we discontinue the service, we will aim to give reasonable advance notice and, where practicable, an opportunity to download saved cards before access ends.

11. Deletion and storage

You can delete your account from the account settings. Account deletion is intended to delete the account's cards, pending drafts, feedback, mailing-list record, and account identity. Transaction records may be retained where required for tax, accounting, security, fraud prevention, disputes, or other legal purposes. Individual cards can also be deleted where the app provides that control. Download or print cards you want to keep; we do not guarantee indefinite storage or recovery. Payment-card details are processed by Stripe Checkout, not stored by Appetent Ltd. We may retain limited purchase and credit records, such as transaction IDs, amounts, pack details, timestamps, and credit adjustments, for up to seven years where needed for tax, accounting, fraud prevention, disputes, or other legal obligations. Stripe may retain payment information under its own policies.

12. Suspension and termination

You may stop using the service and delete your account at any time. Appetent Ltd may suspend or terminate access, or restrict particular features, if we reasonably believe there is a serious breach of these Terms, fraud, a chargeback, unlawful or unsafe use, an account-security risk, or a legal or provider requirement. We may also pause or end the service as described in these Terms.

If access ends, you may lose access to cards or other service data that you have not downloaded or printed. Unused paid credits will be handled under the credits and refunds section and are not automatically forfeited solely because access ends. Provisions that by their nature should continue, including ownership, acceptable use, disclaimers, liability, and dispute terms, will continue to apply.

13. Third-party services

The service relies on providers including OpenAI, Apiframe, Apify (automatic backup for creature images), Vercel Blob, Supabase, Google OAuth, Stripe, Resend, and PostHog when enabled. Their services may have separate terms, limits, and safety rules. Our Privacy Policy explains what information is shared with them. We do not opt in to using customer prompts or images to train our own models and use provider settings or contractual terms where available.

14. Availability and liability

The service is provided on an evolving, as-available basis. We use reasonable safeguards but cannot promise uninterrupted availability, error-free generation, permanent storage, or absolute security. To the extent permitted by law, Appetent Ltd's liability relating to a claim is limited to the amount the user paid for the relevant service or credits. This does not exclude rights or remedies that cannot legally be excluded, including mandatory consumer protections.

15. Updates and governing law

We may update these Terms as the service or law changes. We will publish the updated version and its effective date. New functionality, security updates, bug fixes, or a court order may take effect when notified where appropriate. These Terms are governed by New Zealand law, subject to mandatory rights available in the user's place of residence. Disputes will be handled by the courts of New Zealand unless applicable law requires another forum or process.
